What is the Sexual Misconduct Background Check?
Pursuant to Washington state law, chapter 28B.112 RCW all Washington state higher education institutions are required to conduct a background check to verify whether the individual has a history of prior sexual misconduct before extending an offer of employment. For the purposes of completing this background check, sexual misconduct is defined as follows:
“Sexual Misconduct includes, but is not limited to, unwelcome sexual contact, unwelcome sexual advances, requests for sexual favors, other unwelcome verbal, nonverbal, electronic, and any misconduct that is in violation of the postsecondary educational institution’s policies or has been determined to constitute sex discrimination pursuant to state or federal law. RCW 28B.112.040.”
